By creating an account, accessing, or using Pharmogram's services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. If you are accessing our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our platform. We will notify registered users of significant changes via email or in-app notifications.

For the purpose of these Terms and Conditions, the following definitions apply:

• "Platform" refers to the Pharmogram mobile application, website, and all related services.
• "User" refers to any individual or entity that accesses or uses the Platform.
• "Medicines" includes prescription drugs, over-the-counter medications, healthcare products, and medical devices.
• "Order" means a request to purchase products through our Platform.
• "Seller" refers to licensed pharmacies, stockists, and authorized medicine retailers on our Platform.
• "RMP" refers to Registered Medical Practitioners who may facilitate medicine delivery in certain areas.
• "Prescription Medicines" are drugs that require a valid prescription from a registered medical practitioner.

To use certain features of Pharmogram, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.

Account Responsibilities:

• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized access or security breach.
• You are liable for all activities that occur under your account.
• One person may maintain only one active account.
• Account sharing or transfer is strictly prohibited.

For business accounts (Medical Representatives, Stockists, Chemists), additional verification including license documentation may be required before account activation.

When you place an order through Pharmogram, you are making an offer to purchase products subject to these terms. All orders are subject to acceptance and availability.

Order Process:

• Orders are confirmed only after successful payment or acceptance of Cash on Delivery.
• We reserve the right to refuse or cancel any order for any reason.
• Prices displayed are subject to change without notice until order confirmation.
• All prices are in Indian Rupees (INR) and include applicable taxes unless stated otherwise.

Payment Methods: We accept various payment methods including UPI, credit/debit cards, net banking, digital wallets, and Cash on Delivery (subject to availability). All online payments are processed through secure, PCI-DSS compliant payment gateways.

Certain medicines classified as Schedule H, H1, or X drugs under the Drugs and Cosmetics Act, 1940 require a valid prescription from a registered medical practitioner.

Prescription Guidelines:

• Prescriptions must be from a registered medical practitioner (MBBS or equivalent).
• The prescription must be legible and include patient name, doctor details, and medication specifics.
• Prescriptions are valid for the period specified by the prescribing doctor or as per regulatory guidelines.
• We may contact the prescribing doctor for verification if needed.
• Expired or tampered prescriptions will not be accepted.
• Original prescriptions may be required for certain controlled substances.

Our licensed pharmacists review all prescriptions before order fulfillment. We reserve the right to refuse any order if the prescription is found to be invalid, suspicious, or non-compliant with regulations.

Pharmogram strives to deliver your orders accurately and on time. Delivery timelines are estimates and may vary based on location, product availability, and other factors.

Delivery Terms:

• Delivery is available across 500+ cities and 25,000+ pin codes in India.
• FREE delivery is available in areas served by Pharmogram stores or RMP doctors.
• Standard delivery charges apply for other areas based on order value.
• Express and same-day delivery options are available in select metro cities.
• Temperature-sensitive medicines are shipped via cold-chain logistics.
• Delivery attempts will be made up to 3 times before order cancellation.

Risk of loss and title for products pass to you upon delivery. Please inspect packages at the time of delivery and report any damage immediately.

We accept returns for damaged, expired, or incorrect products. Return requests must be raised within 48 hours of delivery through the Pharmogram app.

Eligible for Return:

• Damaged or broken products received at delivery.
• Expired medicines or products with less than 3 months validity.
• Wrong items delivered (different from what was ordered).
• Missing items from the order.
• Products with visible quality defects.

Not Eligible for Return:

• Opened or used medicines with broken seals.
• Products returned beyond the 48-hour window.
• Temperature-sensitive medicines once successfully delivered.
• Items without original packaging.
• Damage caused by customer mishandling.

Refunds are processed within 24-48 hours of return approval. The refund timeline to your account depends on your payment method (instant for wallet, 5-7 days for cards/bank).

All content on the Pharmogram platform, including but not limited to text, graphics, logos, icons, images, audio clips, software, and data compilations, is the property of Pharmogram or its content suppliers and is protected by Indian and international copyright laws.

Restrictions:

• You may not reproduce, distribute, or create derivative works from our content.
• Commercial use of any content without written permission is prohibited.
• Our trademarks, logos, and brand elements may not be used without authorization.
• Reverse engineering, decompiling, or disassembling our software is forbidden.
• Scraping, data mining, or automated data collection is not permitted.

Any feedback, suggestions, or ideas you provide may be used by Pharmogram without any obligation to compensate you.

By using Pharmogram, you agree to use the platform responsibly and in compliance with all applicable laws. You agree not to:

• Provide false, misleading, or inaccurate information.
• Use the platform for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to our systems or user accounts.
• Transmit viruses, malware, or any malicious code.
• Interfere with or disrupt the platform's functionality.
• Harass, abuse, or harm other users or our staff.
• Post or transmit defamatory, obscene, or offensive content.
• Engage in fraudulent activities or misuse promotional offers.
• Resell medicines purchased through the platform.
• Create multiple accounts to circumvent restrictions.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Principles:

• We collect only information necessary to provide our services.
• Your health information is treated with strict confidentiality.
• We use industry-standard security measures to protect your data.
• We do not sell your personal information to third parties.
• You have rights to access, correct, and delete your data.
• We comply with applicable data protection laws including IT Act, 2000.

To the maximum extent permitted by applicable law, Pharmogram and its affiliates, directors, employees, agents, and partners shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, or business opportunities.
• Any damages arising from unauthorized access to your account.
• Service interruptions, delays, or errors beyond our reasonable control.
• Actions or omissions of third-party sellers on our platform.
• Medical outcomes resulting from use or misuse of purchased medicines.

In no event shall our total liability exceed the amount paid by you for the specific order giving rise to the claim. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties including but not limited to:

• Merchantability and fitness for a particular purpose.
• Non-infringement of third-party rights.
• Accuracy, reliability, or completeness of content.
• Uninterrupted, timely, or error-free service.
• That defects will be corrected.
• That the platform is free of viruses or harmful components.

Product information, including descriptions, images, and specifications, is provided by manufacturers and sellers. While we strive for accuracy, we do not guarantee the completeness or accuracy of such information.

Either party may terminate this agreement at any time. You may terminate by discontinuing use of the platform and deleting your account. We may terminate or suspend your access immediately, without prior notice, for any reason including:

• Breach of these Terms and Conditions.
• Suspected fraudulent, abusive, or illegal activity.
• Request by law enforcement or government agencies.
• Extended periods of inactivity.
• Discontinuation of the platform or any part thereof.
• Technical or security issues.

Upon termination, your right to use the platform ceases immediately. Provisions relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Dispute Resolution:

• Any disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra, India.
• Before initiating legal proceedings, parties agree to attempt good-faith negotiation.
• For disputes under ₹50,000, matters may be referred to consumer forums.
• Class action lawsuits are waived to the extent permitted by law.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
